Evaluation Service Agreement

Please review the terms of service below for your upcoming Pylon Docktors™ evaluation:

  1. Evaluation Service: Pylon Docktors™ will perform a visual, non-invasive evaluation of visible and reasonably accessible dock steel pylons for signs of corrosion, scaling, pitting, section loss, coating failure, and related deterioration. A localized thickness measurement evaluation report will be provided following the evaluation.
  2. Payment and Credit Toward Work: Customer agrees to pay the evaluation fee before or at the time of the evaluation. If the Customer decides to accept a preservation, protection, or remediation package from Pylon Docktors™ and executes a separate service/repair agreement within 30 days, the evaluation fee will be applied as a credit toward the final project contract price. If the Customer does not move forward with remediation services, the evaluation fee is fully earned and non-refundable.
  3. Limits of Evaluation: This evaluation represents a localized material condition assessment based strictly on visible and accessible elements on the date of evaluation. It is not a structural engineering report, architectural certification, or guarantee of dock safety. It is impossible to determine the material condition of hidden, buried, concealed, or inaccessible sections of a deeply submerged dock pylon. Pylon Docktors™ makes every reasonable effort to verify the physical thickness of remaining base metal on accessible pylons using localized field measurements at visible zones of high oxidation (typically the waterline “necking” zone).
  4. Access Permission: Customer authorizes Pylon Docktors™ and its representatives to access the property, shoreline, dock, and related areas to perform the evaluation, and confirms they possess the legal authority to grant such access.
  5. Liability and Separate Repair Agreement: The exclusive remedy for any claims, errors, omissions, or negligence arising out of this Agreement or the resulting report is strictly limited to a refund of the evaluation fee paid. This Agreement covers evaluation and localized asset evaluation services only. Any subsequent repair, reinforcement plating, epoxy coating, restoration, or other physical asset defense work requires a separate written quote and executed service contract signed by both parties.
  6. Exclusion of Litigation Support & Expert Testimony: Pylon Docktors™ provides material condition assessments strictly for maintenance, preservation planning, and independent asset management. The services provided under this Agreement do not include deposition preparation, courtroom testimony, affidavit drafting, or any form of litigation support. This report is non-transferable and third-party reliance is strictly prohibited. In the event the Customer, their legal counsel, or a third party subpoenas Pylon Docktors™ or any of its representatives, the Customer agrees to reimburse Pylon Docktors™ for all associated expenses, including attorney’s fees and a litigation service fee of $250.00/hour.
